Internet Consulting Services L.L.C. (d/b/a ICS Advanced Technologies), an Iowa limited liability company, (“ICS”, we”, “us”, “our”) thanks you for visiting our website. This Privacy Notice (the “Notice”) describes the types of personal data we collect about you when a user (“you”) visits the website https://www.ics-llc.net/ (our "Website"), in email, text, and other electronic messages between you, us and this Website and/or when you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this Notice, or download and use our application (our “App”) and use any of its/their available features and services, including ordering products from us. Types of Data We Collect About You

The following are the categories and types of personal data that we may collect from or about you, depending on how you interact with us:

Direct identifiers. Direct personal identifiers, such as name, online identifier, government identification data, online username or social media handle.

Contact information. Direct personal identifiers such as email address or phone number and indirect identifiers like postal address.

Demographic Information. Indirect identifiers such as age, gender, race, education level, and nationality.

Commercial Information. Products or services you have purchased, payment information such as credit or debit card numbers, and shipping address.

Communication Information: Non-content information (like time of day and addressing information) and content information about your communications with us through the use of social media direct messaging, chatrooms, forums, submission forms, or message boards provided by us, or through phone calls, video calls, emails, and text messages (such as the body of the message you send or the transcript or summary of your phone call).

User Content. Information such as your communications with us and any other content you provide, such as social media profiles, images, videos, survey responses, comments, product reviews, testimonials, and other content.

Profile Information: Inferences drawn from any of the information described above to create a profile about you reflecting your preferences or characteristics.

Audio and Visual Information. Information such as photographs, images, videos, and recordings of your voice (such as when we record customer service calls for quality assurance). We collect personal data automatically as you navigate the Services. The technologies deployed through the Services collect your device information, browsing actions, and patterns as follows:

Device Identifiers. Information about the device you are using, such as device identifier of the equipment you use to access the website, your device type, screen size, the browser you use, hardware model, Media Access Control (MAC) address, IP address, and operating system.

SMS Text Messaging. If you enroll in our SMS text messaging service, we may collect your mobile device provider’s name, the date, time, and content of SMS text messages, and data related to SMS text message usage

Online Identifiers. Persistent or probabilistic identifiers gathered from Online Tracking Technologies (discussed below), such as cookies, beacons, trackers and pixels, used to pseudonymously identify you and your website preferences.

Usage Information. Information about your interaction with the Services, such as the pages you access on the Services, the frequency of access, what you click on, referring URL, traffic data, and when you accessed the website, and your clicks, taps, scrolls on the Services.

Location Information. Information about your location, which may be determined through your device’s IP address, and may include precise geolocation information.

Clickstream Data. We may record what you have clicked while on the Services. This data can tell us Device Identifiers and the address of the website from which you linked to the website. We may collect and use clickstream data as a form of aggregate information to anonymously determine how much time visitors spend on each page of the website, and how customers navigate to and on the website.

Social Media Platforms and Networks. The Services may include social media features and plugins, such as Instagram and Facebook widgets. These plugins may use Online Tracking Technologies (discussed below) to collect information about your internet activity, such as Device Identifiers and which page you are visiting on the website. Such social media features are hosted by third-parties and your interactions with those features are governed by the privacy notices of the companies that provide them.

Children’s Data

The Services are not marketed to, and we do not knowingly collect or maintain personal data from, children under the age of 16. The Services are not intended for children under 16 years of age. We do not use personal data collected from children for marketing or promotional purposes, and we do not disclose such information to any third-party for any purpose whatsoever. No one under age 16 may provide any personal data to or on the Services. If you are under 16, do not provide any information on the Website or on or through any of the features of the Services, register on the Services, make any purchases through the Services, use any of the interactive or public comment features of the Services, or provide any information about yourself to us. If we learn we have collected or received personal data from a child under 16 without verification of parental consent, we will delete that information. Parental control protections (such as computer hardware, software or filtering services) are commercially available that may assist you, as a parent or guardian, in limiting access to material that is harmful to minors. Pixels / Web Beacons

We, or Third-Parties, may employ a software technology called web beacons (also known as web bugs, clear gifs or pixels). Web beacons are tiny graphics with a unique identifier, similar in function to cookies, and are used to let us know when content is viewed. How We Use Your Data

We use data collected for the following purposes:

• To respond to your inquiries through webforms, email, or instant / direct message on social networks;

• SMS text communications, including internal communications for multi-factor authentication (MFA) and other internal ICS purposes. (Marketing, promotional, or advertising messages are not sent by us via SMS text messages.) If you have agreed to receive SMS text communications from us, ICS may use your data to send you text messages about outages, maintenance issues, service reminders and surveys, emergencies, or other matters that may require your attention.

• To provide relevant advertising online to you and measure the success of our marketing campaigns;

Targeted Advertising

We may “share” or “sell” your personal data through the use of certain Third-Party tools on the Services and offline, including those relating to analytics and advertising. Specifically, we may make available certain of your personal data, online identifiers and other persistent online identifiers with advertising, analytics, and marketing partners that may be considered a “sale” or“sharing” of your personal data as defined under applicable law. Service Providers and Business Partners

Our Service Providers and Business Partners are required to meet appropriate security standards when processing your personal data, and only receive your personal data after entering into a written contract with us. The information we provide them, including your personal data, will only be processed in connection with the performance of their function. They will not be permitted to use your information for any purposes other than as permitted by the contract.

• To Prevent Harm. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of ICS, our customers, or others. This includes exchanging information with other companies and organizations, including law enforcement agencies, for the purposes of fraud protection and credit risk reduction.

• For ICS SMS Text Messaging Only: No mobile device information will be collected for or sold to or shared with third parties/affiliates for, marketing or promotional purposes. SMS text messaging opt-in data and consent will be collected and will not be sold to or shared with any third parties. SMS text message recipients may opt-out of future messages at any time.

Retention

We retain data for as long as necessary to fulfill the purposes described in this Notice, including providing services, maintaining business and financial records, resolving disputes, enforcing agreements, securing our systems, and complying with legal obligations. We determine retention periods based on the type of information, the nature of our relationship with you, legal requirements, and technical constraints. We permanently delete or destroy data when it is no longer needed for these purposes.

Security of Your Data

We use appropriate technical, organizational, and administrative security measures to protect any personal information we store from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. However, no company or service, including ICS, can guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of your personal data at any time.

The following is information about how to opt out of receiving certain communications from us, depending on means of delivery:

• E-mails. You can opt-out of receiving promotional emails from us at any time by following the instructions as provided in emails to click on the unsubscribe link or emailing us at the email address set out as set out in the Contact Us section below with the word UNSUBSCRIBE in the subject field of the email. Please note that you cannot opt-out of non-promotional emails, such as those about your account, transactions, servicing, or our ongoing business relations.

• Phone & SMS Text Messaging. You can opt-out of receiving text messages or calls to your phone number at any time by (i) for text messages, texting “STOP” in response to any text message you receive from us or contacting us as set out in the Contact Us section below and specifying you want to opt-out of text messages, or reply “HELP” for more information; and (ii) for calls, requesting opt-out during any call you receive from us or contacting us as set out in the Contact Us section below and specifying you want to opt-out of calls.

• Push Notifications. If you have opted-in to receive push notification on your device, you can opt-out at any time by adjusting the permissions in your device or uninstalling our mobile application.

Your Privacy Rights

You may have certain rights related to your personal information, depending on your location and the applicable data protection laws. These rights may include, subject to any exceptions or limitations:

Right to Know Specific “Third-Parties” Receiving Personal Data: You have the right to know the specific Third-Parties to whom we have disclosed your personal data. If we decline to act in response to your rights request, you also may Appeal the Denial by providing your appeal through the Contact Us section below.

You may exercise any of the above rights or appeal our denial of your rights request contacting us at privacy@ics-llc.net. Additionally, you may exercise your Right to Opt-Out of Sale and Right to Opt-Out of Targeted advertising using an Opt-Out Preference Signal as described below.

For the security of your personal data and our own legal obligations, we will require you to verify your identity with us for all rights requests, other than to Opt-Out of Sale and Opt-Out of Targeted Advertising.

If you have an account with us, we will require you to exercise your rights through your account. We will also ask you to provide additional verification information if you are exercising your right to Personal Data Portability and requesting “Sensitive” Personal Data.

Please note that if you do not log into your account, or you have not created an account with us, your request to Opt-Out of Sale and Opt-Out of Targeted Advertising will be linked to your browser identifier. This means that if you use a different browser or device and aren’t signed in to your account, you will have to re-submit the request.

Authorized Agents

If you are an authorized agent seeking to exercise a right on behalf of another individual, you can do so through, we will ask you to submit documented evidence of a lawful power of attorney or other proof that the individual gave you written permission to act on their behalf.

Do Not Track

We do not respond to “Do Not Track” (“DNT”) signals sent from your web browser. DNT signals are an HTTP header field that specifies a user’s preference about data collection. There is no consensus on how to respond to DNT signals because there is no uniform technology standard for recognizing and implementing DNT signals, and a DNT standard has never been formally adopted. The World Wide Consortium (“W3C”) formally withdrew support of their recommendation for a standard in 2019, and while some browsers will transmit the DNT signal to our Website, other browsers (such as Safari and Firefox) no longer support send DNT signals.

Global Privacy Control

Our Website responds to the Global Privacy Control (“GPC”) which is a website specification that allows your browser to tell us that you want to automatically exercise your Right to Opt-Out ofTargeted Advertising or Right to Opt-Out of “Sale” (learn more about GPC at www.globalprivacycontrol.org). For clarity, the GPC opt-out is on a per-website basis and applies at the browser level for the device you use to opt out.

Your California Privacy Rights

We are required to provide the categories of personal information that we that we collect and/or share for the purposes described in the section “How we use your data” section above, and to the processors and third parties listed in the “Service Provider” section above.

If you would like to access, review, update, correct, delete any Personal Information we hold about you, or exercise any other privacy rights available to you, including the right to opt out from selling or sharing your personal information, you can send your request to privacy@ics-llc.net.

We try to respond to a privacy rights request within the required timeframes (up to forty-five (45) days). If we need more time, we will inform you of the reason and extension period in writing. If you submit the request with us via email, we will deliver our written response by mail or electronically, at your option. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

We may collect and in the past twelve (12) months or may have collected the following categories of personal data for our business purposes:

• Personal identifiers.

• Personal information categories listed in the California Customer Records statute (Cal.Civ. Code § 1798.80(e)).

• Commercial information (such as transaction data).

• Internet or other similar network activity.

• Geolocation data.

• Audio, electronic, visual, or similar information.

• Inferences drawn from any of the above categories of personal information.

Sources of Personal Information: The sources from which we collect personal information are described in the “Sources of Personal Data” and “How Personal Data is Collected” sections above.

Purposes for Collecting Personal Information: We collect and disclose the personal information identified in the lists above for the purposes outlined in the “How We Use Your Data” section above.

Categories of Personal Information Shared in the Preceding Twelve (12) Months The Company does not sell personal information in exchange for any monetary consideration. We do not share personal information for other benefits as defined by Cal. Civ. Code § 1798.140(subsections a-d) and some of these activities may be deemed a “sale” under applicable law. Select third parties, such as advertising partners, data analytics providers, and social networks, may collect or receive information so that we or they can engage in targeted advertising. You have a right to direct us not to sell or share your Personal Information. We do not knowingly sell or share the Personal Information of consumers who are under 18 years of age.

Recipients of Personal Information

We have disclosed in the preceding twelve (12) months Personal Information as necessary for specific “business purposes,” as defined by Cal. Civ. Code § 1798.140(e) and specified in the section “How We Use Your Data” above. This includes sharing personal identifiers, commercial information, and internet or other electronic network activity with payment processing providers, customer relationship management, consulting, e-mail, customer feedback, helpdesk services, advertising networks, website analytics companies, and event sponsors.

Broadband and network data disclosures

If you subscribe to our broadband internet access services, we collect and process network data necessary to provide and operate those services. This includes IP addresses, MAC addresses and other device identifiers, network performance and traffic metadata, session times and durations, bandwidth usage, Wi Fi SSID and signal metrics, and diagnostic logs. We use this information to authenticate devices and users, route traffic, manage network performance, troubleshoot issues, detect and prevent fraud and security incidents, and comply with legal obligations. We do not inspect the content of your network traffic except as necessary to provide services, maintain security and integrity, or comply with law. We do not use, sell, or share your browsing history, application usage, or location derived from network data for targeted advertising unless permitted by law and your preferences. You can manage advertising preferences through our privacy choices interface and, where required, opt out of sales and sharing related to online tracking technologies. If your service includes voice offerings that are subject to communications privacy requirements, we handle customer proprietary network information in accordance with applicable law and our voice specific notices.

Video privacy disclosures

Our Services and services provided to you may include video cameras, video content and related features. If you choose to connect your account, provide your email address, or otherwise identify yourself in a manner that links your identity to video viewing, we will not disclose data tied to your viewing history to third parties except with your informed consent or as permitted by law. Where consent is required, we present a clear, separate consent request that describes the scope and duration of the disclosure and your right to withdraw consent at any time. If you withdraw consent, we will cease disclosures covered by that consent. We retain any data associated with video viewing only as long as necessary to fulfill the purposes described at the time of collection or as required by law. We may disclose de-identified or aggregated information that does not identify you and is not reasonably linkable to you. We take steps to ensure that third party pixels or SDKs are not configured to receive your viewing data absent your consent.

Maine broadband privacy addendum

If you are a customer of our broadband internet access services in Maine, we provide additional protections for your online customer data. We do not use, disclose, sell, or permit access to your data, including web browsing history, application usage, precise geolocation, financial and health information, and device identifiers, except as necessary to provide the broadband service; to advertise or market our broadband services to you; to comply with law; or with your express,affirmative consent. We do not refuse service, charge a penalty, or offer a discount based on your privacy choices, and we do not condition service on your consent to use or disclose your customer personal information beyond what is necessary to provide the service. We maintain reasonable security measures to protect your customer personal information, and we provide a clear, conspicuous notice of these practices. You may withdraw your consent at any time, and we will honor your choice as promptly as practicable.

Payment Processing

We use Stripe as our third-party payment processor. When you make a purchase through the Services, your payment information is provided directly to them, and its usage is governed by their privacy policy, which can be found here https://stripe.com/privacy

ICS only operates in the United States and the Services are governed by the applicable laws of the United States. ICS does not transfer or process your data outside of United States.
